This book deals with the export of the French "model" of law and justice, first in the years immediately after the revolution and subsequently during the Napoleonic era, when large parts of Europe were directy subordinated under French dominion as new "départements" and, from 1804 on, in their entirety were to form the hegemonial empire under the emperor Napoleon Bonaparte (1794-1814). France pursued the objective of a complete assimilation: nothing was supposed to remain the way it had been prior to the conquest, and all inhabitants of the conquered areas were to be converted into regular French citizens. All the longstanding traditions, styles and ways of thinking in the realm of law and justice were to yield to the new, apparently "modern" law codes and procedures. For the first time in its history, then, Europe found itself confronted with the attempt at a thorough globalization. Under the leadership of Napoleon, the continent, having hitherto been characterized by sectionalism and parochial mentalities, was to be changed into a unified entity. On the basis of a comprehensive compilation of sources, the author shows how the energetically pursued attempt at eliminating all manifestations of sectionalism and traditions pertaining to law and justice was eventually bound to fail. In the law courts as well as in practice the "ancient" law was able to survive, and elements of "domestic" justice were preserved. Notwithstanding all attempts at change, the Europe of law and justice at large remained particulate and divided.
